By accessing or using Power Mentor (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including real estate agents, brokers, and any other individuals accessing the platform.

Power Mentor is operated by Power Mentor. ("Company," "we," "us," or "our"). We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

Section 02

Description of Service

Power Mentor is an AI-powered coaching platform designed specifically for real estate professionals. The Service includes, but is not limited to:

• AI-driven coaching sessions with personalized coaching personas
• Goal tracking, action item generation, and session summaries
• Brokerage and coach matching tools
• Business development resources and objection-handling training
• Email coaching follow-ups and performance debriefs
• Integration with real estate workflows and CRM systems

The Service is intended for professional development purposes only and does not constitute legal, financial, brokerage, or investment advice.

Section 03

Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You will use the Service only for lawful purposes consistent with these Terms
• All information you provide is accurate, current, and complete

Section 04

Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Section 05

Subscription Plans and Billing

5.1 Subscription Tiers

Power Mentor offers multiple subscription tiers (Starter, Pro, and Team) with varying features and usage limits. Details of each plan, including pricing and included features, are available on our pricing page.

5.2 Billing

Subscriptions are billed on a monthly or annual basis, as selected at signup. By providing payment information, you authorize us to charge the applicable fees to your payment method. All fees are non-refundable except as expressly stated in our Refund Policy.

5.3 Free Trial

We may offer a 14-day free trial for new users. At the end of the trial period, your account will automatically convert to the selected paid plan unless you cancel before the trial expires.

5.4 Changes to Pricing

We reserve the right to change subscription pricing with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Acceptable Use

You agree to use the Service only for its intended purpose. You may not:

• Use the Service to violate any applicable law or regulation
• Impersonate any person, entity, or AI persona
• Attempt to reverse-engineer, scrape, or extract the underlying AI models or data
• Use the Service to transmit spam, malware, or harmful content
• Share your account credentials with unauthorized third parties
• Use the Service to compete with or replicate Power Mentor's core functionality
• Attempt to circumvent any usage limits, security features, or access controls

AI Coaching Disclaimer

Power Mentor's coaching personas are AI-generated characters designed for educational and motivational purposes. You acknowledge and agree that:

• AI coaches do not replace licensed professionals, brokers, or human mentors
• Coaching content is for informational purposes only and does not constitute legal, financial, or real estate transaction advice
• AI coaches will not provide guidance on specific contracts, legal disputes, or regulatory compliance
• Results from coaching are not guaranteed, and individual outcomes will vary
• The Company is not liable for any business decisions made based on AI coaching output

Section 08

Intellectual Property

All content, features, and functionality of the Service—including but not limited to AI coaching personas, prompts, software, text, graphics, logos, and data—are the exclusive property of Power Mentor. and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal professional development. You may not reproduce, distribute, modify, or create derivative works from any Service content without our express written permission.

Section 09

User Content

By submitting content to the Service (such as agent profiles, session responses, or uploaded documents), you grant Power Mentor a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.

You retain ownership of your content and are solely responsible for its accuracy and legality. We do not claim ownership of your personal or professional data.

Section 10

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Section 11

Termination

We may suspend or terminate your account at our discretion, with or without notice, for violations of these Terms or for any other reason we deem appropriate. You may cancel your account at any time through your account settings.

Upon termination, your right to use the Service will immediately cease. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POWER MENTOR, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts located in Florida.
